Terms & Conditions

These Terms & Conditions (“Terms”) apply to all visitors, waitlist subscribers, and members (“you”) who access the website, purchase a membership, place a deposit, or use The Work Club (“Work Club,” “we,” “us”). By using our services or entering the space, you agree to these Terms.
1) What The Work Club is
The Work Club is a membership-based coworking club with open seating and shared amenities.
What we don’t promise (shared space realities):
We aim for a calm, productive environment, but we do not guarantee silence or a particular noise level at all times.
Seating is open and first come, first served. Membership does not guarantee a specific seat or that seating will be available at a particular time.
We do not provide private offices, dedicated desks, or legal/financial advice.
2) Eligibility and account information
You must be at least 18 years old to purchase a membership and use the space without a parent or guardian.
You agree to provide accurate contact and billing information and keep it up to date.
Membership access (including QR codes and credentials) is for the member only and may not be shared.
3) Membership plans, fees, and renewals
Membership price: Standard membership is $100/month unless otherwise stated at the time of purchase.
Billing: Memberships are billed in advance on a recurring basis (monthly), beginning on the date your membership starts.
Taxes and third-party fees: You are responsible for applicable taxes and any payment processor fees charged to you.
Changes: We may change pricing or included features. If your price changes, we will give reasonable advance notice.
4) Deposits and “secure your spot” payments
If you place a deposit to reserve a spot (for example, a $50 deposit):
The deposit is applied as a credit toward your first membership payment unless we clearly state otherwise.
Deposit refund terms are as described at the time you place the deposit.
If the deposit is marketed as “fully refundable,” then it is refundable upon request, subject to verification and fraud prevention.
5) Cancellation, pausing, and refunds
Cancel anytime: You can cancel your membership at any time through the method provided at signup (for example, your billing portal) or by contacting us.
No prorations (default): Unless required by law or explicitly promised in writing, we do not provide prorated refunds for partial months.
Failed payments: If a payment fails, we may suspend access until payment is resolved.
6) Access hours, entry, and security
Work Club access may be 24/7 for members, but may be limited for maintenance, safety, events, emergencies, or by law.
You must follow posted entry procedures and any staff instructions.
Do not prop doors open or allow tailgating.
We may use security cameras in common areas for safety and loss prevention.
7) House rules (how to be a good member)
We want the space to stay calm, friendly, and productive.
You agree to:
Treat people with respect. No harassment, discrimination, intimidation, or threatening behavior.
Keep calls at a reasonable volume and be mindful of others.
Use phone booths / designated areas when privacy is needed.
Keep your area clean and return furniture and supplies.
Follow posted food, beverage, and cleanliness guidelines.
Respect staff decisions about noise, conduct, and appropriate use of the space.
Not allowed:
Illegal activity or possession/use of illegal drugs.
Weapons on premises except as permitted by law and by our posted policies.
Smoking or vaping indoors.
Excessive intoxication.
Solicitation that disrupts others.
Damage, theft, or misuse of equipment.
8) Guests
Members may bring up to one (1) guest at a time, subject to capacity and house rules.
Guest access is intended for occasional visits. We may limit guest frequency and/or require a guest to become a member if they visit regularly.
Members are responsible for their guests’ conduct and for any damage caused by guests.
9) Reservations and shared resources
Some resources (for example, phone booths or meeting areas) may require reservations, time limits, or fair-use rules. You agree to follow posted limits and booking policies.
10) Internet and acceptable use
We provide internet access as a convenience.
We do not guarantee uninterrupted service, bandwidth, or security.
You are responsible for securing your own devices and accounts.
You may not use our network for unlawful activity, spam, or anything that interferes with others.
11) Personal property
You are responsible for your personal items. We are not responsible for loss, theft, or damage to personal property, except where required by law.
12) Damage to the space
If you (or your guest) damage the space, furniture, or equipment, you are responsible for the cost of repair or replacement. We may charge the payment method on file where permitted.
13) Health and safety
Do not enter if you are sick with a contagious illness that could put others at risk.
Follow safety signage and instructions.
In an emergency, call 911 and notify us as soon as possible.
14) Assumption of risk and release of liability
You understand that using a shared space involves risks, including slips, trips, exposure to illness, and interactions with other people.
To the fullest extent permitted by law, you release and hold harmless Work Club LLC, its owners, employees, contractors, and affiliates from claims arising out of your use of the space, except to the extent caused by our gross negligence or willful misconduct.
15) Indemnification
You agree to indemnify and defend Work Club LLC from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of:
your breach of these Terms,
your negligence or misconduct,
your violation of law, or
your use of the space and services.
16) Termination and suspension
We may suspend or terminate your membership (with or without notice, depending on severity) if you violate these Terms, fail to pay, or if we believe your conduct puts people, property, or operations at risk.
If your membership is terminated for cause, refunds are not guaranteed and will be handled consistent with Section 5 and applicable law.
17) Events, photos, and media
We may host events. Space availability and noise levels may vary.
If we take photos or video in the space for marketing, we will avoid focusing on individuals without permission when reasonably possible.
You may not photograph or record other members in a way that invades privacy or disrupts work.
18) Intellectual property
Our brand, logo, website content, and materials are owned by Work Club LLC or our licensors and may not be used without permission.
19) Privacy
Our privacy practices are described in our Privacy Policy.
20) Disclaimers
To the fullest extent permitted by law, the Work Club services and website are provided “as is” and “as available,” without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
21) Limitation of liability
To the fullest extent permitted by law, Work Club LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill.
If liability cannot be excluded, our total liability for claims related to your membership or use of the space will not exceed the amount you paid to us in the one month preceding the event giving rise to the claim.
22) Dispute resolution and governing law
Governing law: These Terms are governed by the laws of the State of Ohio, without regard to conflict of law rules.
Venue: Any dispute will be brought in the state or federal courts located in Cuyahoga County, Ohio, unless otherwise required by law.
23) Changes to these Terms
We may update these Terms from time to time. The updated version will be posted with a new effective date. Continued use of the space or services after the effective date means you accept the updated Terms.

Mobile Terms of Service

The Work Club mobile message service (the “Service”) is operated by The Work Club (“The Work Club,” “we,” or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to The Work Club’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of The Work Club through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with The Work Club. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to [insert your sending number] or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other The Work Club mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
